Step 1: Prepare the sponsorship documents

First, to begin preparing the application, you need to ensure that you and your spouse meet the necessary conditions to open a sponsorship case. If you’re unsure whether you qualify, check here.

If you meet the stated requirements, you can start the sponsorship process by preparing the necessary documents to submit to USCIS, including Form I-130 and additional supporting documents.

Step 2: Submit the sponsorship application to USCIS

After preparing all the necessary documents, you and your spouse need to check if you need to submit Form I-485 (Application to Register Permanent Residence or Adjust Status) at the same time. You can determine this through the USCIS website or refer to the summary table below.

Additionally, before proceeding to the next step in the spousal sponsorship process, you should note that the location where Form I-130 is submitted depends on the sponsor’s residence. Specifically:

1. If the sponsor resides in the United States

The sponsor has two options to submit the sponsorship application to USCIS:

a) Online:

To submit the sponsorship application online, the first step is to create an account. For more details, you can visit the USCIS account creation page.

Note:

  • Currently, you cannot submit Form I-485 online.
  • Additionally, you cannot submit Form I-130 online if you are applying for a fee waiver.

However, the sponsor can still submit Form I-130 online even if the spouse is in the U.S. After submission, USCIS will send a receipt to the sponsor’s USCIS account. The sponsor needs to send a copy of the receipt to their spouse and submit it along with Form I-485 by mail.

b) By Mail:

The sponsor can submit the application at the Chicago, Dallas, Elgin, or Phoenix Lockbox, depending on where you live and whether you need to submit Form I-485 simultaneously.

2. If the sponsor resides outside the United States:

  • Submit to the USCIS Elgin Lockbox
  • Submit online via the USCIS website; or
  • Request to submit at a U.S. Embassy or Consulate in certain limited cases

Step 3: Complete paperwork at the National Visa Center (NVC)

After your sponsorship application is approved by USCIS, it will be transferred to the National Visa Center (NVC). The NVC will send a welcome letter to the sponsor via email or mail. Based on this letter, the sponsor can log into the Consular Electronic Application Center (CEAC) to check the status and manage the application.

Next, the sponsor needs to pay the processing fee on CEAC. After submitting the payment, you and your spouse will need to wait about 10 days for the NVC to process it.

When the NVC confirms the payment, you need to log into CEAC and complete the DS-260 visa application. After finishing, print the confirmation page and bring it to the interview. Finally, you and your spouse need to scan and compress the prepared documents to submit on CEAC.

Note: Do not send any documents to the NVC unless instructed.

Step 4: Prepare for the interview at the Consulate

If the NVC confirms that you and your spouse have paid the necessary fees, submitted the required immigrant visa application, Affidavit of Support, and supporting documents, you will receive an email notification that your paperwork is complete. The NVC will then coordinate with the appropriate U.S. Consulate based on the residence of the beneficiary to schedule an appointment.

For example, if the beneficiary is in Ho Chi Minh City, Vietnam, the NVC will work with the U.S. Consulate General in Ho Chi Minh City to schedule the interview.

Before the interview, you need to schedule a medical examination with an embassy-approved physician in the country where the beneficiary will have the interview. Additionally, make sure to prepare the necessary documents to bring to the interview. For details, refer to the spousal sponsorship documents.

Step 5: Interview at the Consulate

After completing the previous steps, based on the scheduled time provided, you should bring the prepared documents to the consulate for the interview. If successful, you will be informed about how and when your passport and visa will be returned. If the visa is denied, the consular officer will inform the beneficiary of the reasons for ineligibility.
